Before using, accessing and accepting any kind of invitation to use our media and marketing services, please read the following Terms of Service carefully as by accessing or using our services, you are agreeing to be bound by Mediaalacarte.net's Terms of Service.

"Agreement" means all the rights and obligations within these Terms of Service.
"Mediaalacarte.net" refers to our company, Media Alacarte Agency, address in King Khalid Road, Diriyah, Riyadh, Kingdom of Saudi Arabia, our website, our services, or a combination of all or some of the preceding definitions, depending on the context in which the word is used.
"Service" refers to our website itself, as well as all services that we provide through it or otherwise, including: (i) the automated media plan creation and campaign facilitation platform (Platform Role), whereby MALC generates customised media plans and relays User Creatives to the User's own connected digital and social media accounts; and (ii) the full-service advertising agency offering (Agency Role), whereby MALC creates and implements bespoke media and advertising plans using MALC's own advertiser accounts upon User approval.
"Website" refers to our website, www.mediaalacarte.net.
"User" refers to you or anyone who uses our Service, or accesses our website, regardless of whether it is a visitor, a registered user, a client, or a media agency. The terms "User" and "Client" are used interchangeably throughout these Terms and refer to the same party.
"You" refers to you as the person who is accepting this Agreement with us, Mediaalacarte.net, whether a legal entity or natural entity.
"Client" refers to the User, i.e. the person or organisation that has engaged Mediaalacarte.net for Services. The terms "Client", "User", and "you" are used interchangeably throughout these Terms.
"MALC" means Media a la Carte Agency, the company operating Mediaalacarte.net, located at King Khalid Road, Diriyah, Riyadh, Kingdom of Saudi Arabia.
"Creatives" means all content, creative materials, advertising assets, images, videos, audio, text, artwork, logos, trademarks, trade names, slogans, and any other materials provided by the User to MALC for the purposes of media plan implementation or advertising publication.
"Platform Role" means the service mode in which MALC acts as a media plan creation and facilitation platform, relaying the User's Creatives to the User's own connected digital and social media accounts without MALC reviewing the Creatives.
"Agency Role" means the service mode in which MALC acts as a full-service advertising agency, creating a customised media and advertising plan for the User and publishing campaigns using MALC's own advertiser accounts upon User approval.
"AI-Supported Media Content" means any media, advertising, marketing or campaign content that is created, generated, modified, enhanced, optimised, translated, personalised, ranked, recommended or otherwise materially affected, in whole or in part, through artificial intelligence systems, automated systems, machine learning tools, generative AI tools or similar technologies.
"AI Principles in Media" means any applicable Saudi Arabian principles, guidance, regulations, directives, circulars, content controls or regulatory requirements relating to the responsible use of artificial intelligence in media, including requirements relating to transparency, disclosure, accuracy, privacy, deepfakes, misleading content, public figures, impact assessment, and handling of violations.
"Deepfake" means AI-generated or AI-manipulated audio, image, video or other media that simulates, imitates or represents a real person, including their voice, image, likeness, identity, words or actions.
"Misleading AI Content" means AI-Supported Media Content that is false, fabricated, materially inaccurate, incomplete, de-contextualised, manipulated, deceptive, fraudulent, impersonating, or otherwise likely to mislead the public, affect reputation, distort public opinion, or unlawfully influence behaviour, choices or decisions.
"Public Figure" means any person with public influence, public office, public visibility or public presence, including officials, media personalities, influencers, celebrities, public speakers, decision-makers and similar persons.
"High-Impact Campaign" means any campaign or content that is news-related, political, social, health-related, public-interest, children-related, relates to Public Figures, involves Deepfakes, uses personal data or likenesses, or is likely to have broad public reach or material influence on audience perception, behaviour, health, decisions or public opinion.
Your use of the Mediaalacarte.net on website or on mobile device, including any Mediaalacarte.net information, products, channels, advertise, software, data feeds, features and services, is subject to the terms and conditions of this legal agreement between you and Mediaalacarte.net.
Your legal agreement with Mediaalacarte.net is determined by this agreement as well as the following Terms enclosed with this document:
Media a la Carte ("MALC" or "Mediaalacarte.net") operates in two distinct service roles, and the rights and obligations of both parties under this Agreement may differ depending on which role applies to the services engaged by the User.
In this role, MALC acts as a media plan creation engine. Using algorithms to analyse the User's inputted criteria (including campaign objectives, budget, target audience, geographic scope, and preferred media environments), MALC generates a customised media plan and facilitates its implementation by relaying the User's creatives and campaign materials directly to the User's own connected social and digital media accounts (e.g. Meta Business Manager, Google Ads, TikTok for Business, and similar platforms). In this role, MALC does not review, assess, or pre-approve the creatives uploaded by the User. Accordingly, the User assumes full and sole responsibility for ensuring that all creatives, content, and materials uploaded to the MALC platform comply with all applicable content guidelines, laws, and intellectual property rights. MALC shall bear no liability whatsoever in connection with content uploaded and relayed under this role.
In this role, MALC acts as a traditional full-service advertising agency. The User engages MALC directly, communicates their marketing objectives and requirements, and the MALC team creates a customised media and advertising plan tailored to the User's needs. Upon the User's approval of the proposed plan, MALC proceeds with publishing and distributing the advertising campaigns using MALC's own advertiser accounts on the relevant digital and social media platforms. In this role, MALC will review the creatives provided by the User prior to publication. However, while MALC may review creatives for operational purposes, MALC does not conduct intellectual property due diligence on behalf of the User. The User remains solely and entirely responsible for obtaining all necessary intellectual property rights clearances, licences, permissions, and consents. MALC shall bear no responsibility or liability, financial or otherwise, for any IP claims.
The Service is based on an algorithm designed by Mediaalacarte.net to find suitable media channels for your interests. You acknowledge that our algorithm may select professional tools in a manner different from the manner in which you or another person might select them, and that results based on the use of Mediaalacarte.net may vary.
The Terms apply to all users of the Service, including users who register for an account and provide their personal information to Mediaalacarte.net. All terms apply equally to any user, regardless of legal status, natural or judicial person, entity, organization or just visitor of the Website.
Where the Service involves AI-Supported Media Content, automated media planning, algorithmic recommendations, campaign optimisation, content generation, content modification, publication, redistribution, or any other AI-enabled media activity, the AI-Supported Media Content clause shall apply in addition to all other provisions of these Terms.
If you are using the Service you have to agree to the herein Terms; you may not use any of the services of Mediaalacarte.net if you do not accept the Terms before using the Service.
You can accept the Terms by simply using the Service, including simply visiting the Mediaalacarte.net Website. Mediaalacarte.net will treat your use of the Service as acceptance of the Terms from that point onwards.
If you represent an organization, by accepting the Terms you guarantee that you have the full right to do so, or that you were granted with full authority to bind the organization to these Terms.
Mediaalacarte.net will stop providing the Services for you if:
We act as a "controller" for personal data we collect to operate the Service and as a "processor" where we process personal data on your documented instructions.
We process personal data only for specified, explicit, and lawful purposes and limit processing to what is necessary.
We implement appropriate technical and organizational measures to protect personal data; however, no system is completely secure.
We respect data subject rights under the PDPL, including rights to access, correction, and destruction, and provide channels to exercise these rights.
Cross-border transfers: where we transfer personal data outside KSA, we will comply with the PDPL and the Regulation on Personal Data Transfer Outside the Kingdom, using mechanisms such as SDAIA standard contractual clauses, binding common rules, or certificates of accreditation, and conducting required risk assessments.

Mediaalacarte.net does not allow any misuse of the Service. You may not interfere with the Service or try to access it using a method other than the interface and the instructions that we provide.
Mediaalacarte.net grants you permission to access or use the Service only if you agree with the following conditions:
The following actions are prohibited and lead to termination of your usage of the Service:
You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Service or Content for any other purposes, without the prior written consent of Mediaalacarte.net or the respective licensors of the Content.
You can create an account by registering your personal information, such as but not limited to, your name, e-mail address, date of birth, payment details, and any other optional information that might help us provide the Service for you.
If you register for an account on Mediaalacarte.net, this action does not represent any obligation to use the Service. You can register only for receiving news and other information about our product and services.
If you chose to use the Service, you are required to provide all the information for creating a media plan for your interest, for example: campaign name, area of interest, media environment (online or offline as magazines, newspapers, tv, OOH, etc.).
You understand that if you chose to share any information that you have provided us or received from us with another person or entity, Mediaalacarte.net does not guarantee any confidentiality with respect to the information you have disclosed to other users, visitors or third parties.
If Mediaalacarte.net becomes aware of any potential violation of these Terms, we reserve the right, but we shall have no obligation, to decide whether the user complies with the requirements set out in these Terms and we may remove any information or terminate the access of the user to the Service at any time, without any prior notice.
If you chose to use the Service and create a campaign with Mediaalacarte.net, you must make the payment before your media plan and campaign is being prepared and/or launched for you.
The payment can be made by credit card, bank transfer or any other accepted payment term by Media Alacarte Agency. If payment is made by credit card, it will be processed by our third party payment processor. All prices, unless otherwise stated, are listed in United States Dollars (USD).
For every product, service, plan, campaign or any other part of the service you need, our fees will be always available to you before you engage in any procedure, to ensure the payment is transparent and you are fully notified of the amount that you are required to pay.
Mediaalacarte.net does not guarantee any final execution of the service that you require. We will provide you with the service and the final media plan that you require, but Mediaalacarte.net cannot be held responsible for any execution that you will not approve. Our generated media plan is created exclusively for you and the payment that you provide us is covering this exact service.
If the media plan that you requested cannot be delivered because of a software issue, an error or an internal situation that Mediaalacarte.net can be held responsible for, you can report us the problem and if the issue is not solved within 14 business days, then Mediaalacarte.net will return the payment that you have made.
The entire contents of our Website is owned, protected and/or licensed to Mediaalacarte.net as per the intellectual property laws applicable in KSA, including international copyright and trademark laws and treaties.
Visiting or providing us with information will not give you ownership of any intellectual property rights in our Service or the Content you access. You may not use any content from our Service unless you obtain permission or license from its owner.
After your media plan is created, you will have the right to use that Content for the interest of your product and company, organization, or personal use, provided that the plan is owned by Mediaalacarte.net. You agree not to change the Content from its original form.
The Website may include links to other websites not owned or controlled by Mediaalacarte.net. We have no control over such links and do not assume any responsibility for their content, privacy policies or practices.
MALC is a publishing and distribution platform and advertising agency. MALC does not create the creatives, content, images, videos, music, artwork, logos, trademarks, trade names, or any other materials submitted by the User. Accordingly, MALC's sole responsibility is limited to the publication and distribution of the Creatives as instructed by the User, and MALC bears no responsibility whatsoever for the acquisition, clearance, or maintenance of any intellectual property rights in or relating to those Creatives.
The User represents, warrants, and undertakes that, prior to uploading or otherwise submitting any Creatives to MALC, the User has obtained all necessary rights, licences, permissions, releases, waivers, and consents from all applicable rights holders. This includes, without limitation: (a) copyright clearances for all images, video footage, music, artwork, text, and other creative works; (b) trademark clearances for all logos, brand names, slogans, and trade marks; (c) model and personality releases for any individuals depicted; (d) property releases where applicable; (e) any licences required by applicable Saudi Arabian law, including without limitation the Saudi Copyright Law; and (f) any platform-specific intellectual property requirements of the social or digital media platforms on which the Creatives will be published.
Where MALC is acting in its Platform Role, the User acknowledges that MALC does not review or inspect the Creatives before they are relayed to the User's connected social and digital media accounts. The User therefore bears sole and exclusive responsibility for ensuring that all uploaded Creatives are fully cleared of all intellectual property obligations and comply with all applicable platform content guidelines and advertising policies.
Where MALC is acting in its Agency Role, the User acknowledges that while MALC may review the Creatives prior to publication for operational and quality purposes, such review does not constitute an intellectual property due diligence exercise or approval of the Creatives' legal compliance. The User remains solely responsible for having obtained all necessary IP rights clearances before submitting the Creatives to MALC.
Any and all intellectual property claims, complaints, takedown requests, enforcement actions, fines, penalties, damages, or other liabilities arising from or in connection with any Creatives provided by the User (whether in the Platform Role or the Agency Role) shall be directed solely to and borne exclusively by the User. The User agrees to indemnify, defend, and hold harmless MALC, its officers, employees, agents, partners, and affiliates from and against any and all IP-related claims, losses, damages, costs (including legal fees), and expenses arising from the User's provision of Creatives that infringe or are alleged to infringe any third-party intellectual property rights.
We make no representations or warranties as to the merchantability of our service or for any particular purpose. You agree that you are releasing us from any liability that we may otherwise have to you in relation to, or arising from this Agreement or the Service.
Media Alacarte Agency and our affiliates, resellers, distributors, and vendors make no warranties, express or implied, guarantees or conditions with respect to your use of the Service. You understand that the use of the Service is at your own risk and that we provide the services on an "as is" basis "with all faults" and "as available". Mediaalacarte.net does not guarantee the accuracy or timeliness of the services.
You agree and acknowledge that online and software systems are not fault-free and occasional periods of downtime occur. We do not guarantee the services will be uninterrupted, timely, secure, or error-free or that content loss will not occur.
Mediaalacarte.net shall not be liable to you or to any other third party for:
When requesting Services, you warrant that all Creatives, content, names, trademarks, or any other materials you provide must comply with: (a) all applicable laws and regulations, including those of the Kingdom of Saudi Arabia; (b) all third parties' advertising policies, including the content guidelines and advertising policies of all social media and digital platforms on which the materials will be published; and (c) all applicable intellectual property rights of third parties, including copyright and trademark requirements. Failure to comply with these terms can result in cancellation and/or termination of Services without notice.
The agreement within this Terms will continue to apply for the whole period of using the Service, until terminated by either you or Mediaalacarte.net.
We may terminate your access to the Account or access to our Website and Service at our discretion without explanation, though we will strive to provide a timely explanation in most cases.
Our liability for refunding you, if you have paid anything to us, will be limited to the amount you paid for services which have not yet been and will not be delivered, except in cases where the termination or cancellation was due to your breach of this Agreement.
If you want to terminate your legal agreement with Mediaalacarte.net, you shall ask for deletion of your account. You may request Account deletion via in-product settings (where available) or by emailing info@mediaalacarte.net. We will process deletion requests within a reasonable period and in accordance with law.
Mediaalacarte.net may at any time terminate its legal agreement with you if: (a) you have breached any provision of the Terms; (b) we are required to do so by law; (c) we are transitioning to no longer providing the Service to users in your country; or (d) the provision of the Service to you is, in our opinion, no longer commercially viable.
In case the termination of the Terms intervenes, all of the legal rights, obligations and liabilities that you and Mediaalacarte.net have benefited from or been subject to shall be unaffected by this termination.
The Terms constitute the whole legal agreement between you and Mediaalacarte.net and completely replace any prior agreements between you and Mediaalacarte.net in relation to the Service.
You agree that Mediaalacarte.net may provide you with notices, including those regarding changes to the Terms, by email if you have provided an address, or postings on the Website.
If any court of law rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the terms. The remaining provisions will continue to be valid and enforceable.
These Terms are drafted in the English language. In the event of any conflict between an English version and any translated version of these Terms, the English version shall prevail to the extent permitted by applicable Saudi Arabian law.
Notices and communications under these Terms shall be in writing and sent to the contact details provided at registration or to info@mediaalacarte.net. MALC may update its contact details by posting the new details on the Website.
Mediaalacarte.net reserves the right to make changes to the Terms from time to time to address changes to the law or regulatory changes to the functionality offered through the Service. The modified version of the Terms will be posted on the Website. Your continued use of the Service after the date the Modified Terms are posted constitutes your acceptance of the Modified Terms.
This Agreement is governed by the laws of the Kingdom of Saudi Arabia, including without limitation the applicable provisions of the Saudi Arabian Anti-Cyber Crime Law, the Personal Data Protection Law (PDPL) and its implementing regulations, the Saudi Copyright Law, and any relevant regulations issued by the Saudi Communications, Space and Technology Commission (CST) or the General Authority for Media Regulation (GAZT/MARCOM) as applicable.
The competent courts in Riyadh shall have exclusive jurisdiction to resolve any dispute arising out of or in connection with this Agreement. MALC reserves the right to seek emergency injunctive or other urgent legal relief in any jurisdiction where necessary to protect its rights.
Mediaalacarte.net reserves its rights to update, amend, change and modify the Terms of Services at any time. Mediaalacarte.net will ensure to notify You with any changes or updated version of the Terms of Services.
Neither party will be liable for delay or failure to perform due to events beyond its reasonable control, including acts of God, natural disasters, war, civil disturbance, governmental action, failure of telecommunications or internet services, or labour disputes.
This clause applies to all AI-Supported Media Content and all AI-enabled features of the Service, including automated media planning, campaign optimisation, targeting, ranking, recommendation, content generation, content editing, content enhancement, publication, redistribution and any use of artificial intelligence in connection with Creatives or campaigns. It applies whether MALC acts in the Platform Role or the Agency Role.
The User represents, warrants and undertakes that all AI-Supported Media Content submitted to, generated through, published through, or distributed with the assistance of the Service shall include clear, accurate and proportionate disclosure of AI use wherever required by applicable law, platform policy, advertising policy, the AI Principles in Media, or where the AI use may materially affect audience understanding, perception, behaviour, health, decisions or trust.
The User shall verify the accuracy, legality, source, context and factual basis of all AI-Supported Media Content before publication or distribution. The User shall not use the Service to create, submit, publish, distribute, amplify or republish Misleading AI Content, false content, materially incomplete content, content removed from its proper context, or content that unlawfully influences public opinion, damages reputation, or affects audience decisions. AI use shall not relieve the User of any editorial, professional, legal, regulatory or contractual responsibility.
The User shall not submit, upload, generate, publish, distribute or request the publication or distribution of any Deepfake, impersonation, simulated identity, simulated voice, simulated likeness, fake statement, fake act, or AI-generated representation of any person without a valid legal basis and, where required, explicit consent and documented releases. The User shall apply heightened care for content involving Public Figures, children, vulnerable persons, private individuals, personal data, images, voices, biometric characteristics, reputation, dignity, safety or identity. Content that is defamatory, threatening, exploitative, abusive, deceptive, fraudulent, harmful to children, or likely to undermine public trust or social cohesion is prohibited.
The User shall not use personal data, images, voices, likenesses, identifiers, behavioural data, sensitive data, children's data, or any other personal information in connection with AI-Supported Media Content unless the User has a valid lawful basis, all required consents, notices, licences and releases, and complies with the PDPL, its implementing regulations, applicable cross-border transfer rules, platform policies and any other applicable privacy or data protection requirements.
For any High-Impact Campaign, the User shall conduct, or provide MALC with the information reasonably required to conduct or support, an appropriate risk and impact assessment before publication or distribution. The assessment should consider potential legal, ethical, social, cultural, health, reputational, privacy, intellectual property, misinformation, algorithmic bias and public-trust risks, and identify reasonable mitigation measures. MALC may require additional approvals, documentation, disclaimers, modifications, human review, or legal/regulatory clearance before proceeding with any High-Impact Campaign.
The User shall not use the Service, Creatives, targeting instructions, audience data, AI tools, algorithms or automated systems in a way that unlawfully discriminates, harasses, bullies, stereotypes, exploits, manipulates, suppresses, deceives, or unfairly favours or disadvantages any person, group, entity, viewpoint or community. The User shall not use AI-Supported Media Content or automated systems to unlawfully influence public opinion, evade content controls, bypass platform review, or undermine public order, public trust, social cohesion or community values.
MALC may, without liability, reject, pause, suspend, restrict, remove, correct, label, disable, or refuse to publish or continue any campaign, Creative or AI-Supported Media Content if MALC reasonably suspects that it may breach these Terms, applicable law, platform policy, the AI Principles in Media, approved content controls, privacy obligations, intellectual property rights, or third-party rights. MALC may also require the User to provide corrections, disclaimers, notices, updated disclosures, substitute Creatives, evidence of rights and consents, or other remedial measures before continuing the Service.
The User is solely responsible for all AI-Supported Media Content, Creatives, instructions, data, approvals, disclosures, consents, licences, releases, claims and representations provided by or on behalf of the User. The User shall indemnify, defend and hold harmless MALC, its officers, employees, agents, partners and affiliates from and against any claims, complaints, investigations, takedown requests, losses, damages, penalties, fines, costs, expenses and liabilities, including legal fees, arising from or relating to AI-Supported Media Content, Misleading AI Content, Deepfakes, inadequate disclosure, privacy or consent failures, IP infringement, Public Figure or personality-rights claims, platform policy breaches, regulatory non-compliance, or breach of this clause.
From time to time, MALC may invite selected Users to participate in a controlled beta programme (the "Beta Programme"). Participation in the Beta Programme is by invitation only, at MALC's sole discretion, and confers no right or entitlement to continued participation, to any future invitation, or to any ongoing waiver of fees beyond those expressly set out in this clause.
As part of the Beta Programme, MALC may issue promotional vouchers ("Vouchers") to selected Beta Programme participants. Vouchers are issued in variable amounts as determined and communicated by MALC to the User at the time of issuance. Each Voucher is personal to the User to whom it is issued and may only be applied to that User's registered account on the Platform.
Subject to the terms and conditions of this clause, each Voucher covers the following costs exclusively: (a) the actual media spend cost of publishing the User's approved campaign on third-party social media and digital advertising platforms (the "Platform Spend"); and (b) the Value Added Tax (VAT) chargeable on that Platform Spend at the prevailing rate applicable under the laws of the Kingdom of Saudi Arabia. Vouchers do not cover any other fees, costs, or expenses not expressly listed here.
When a User redeems a Voucher, MALC's standard agency fees shall be waived in full for the campaign(s) funded by that Voucher. Accordingly, no agency fee and no VAT on agency fees shall be charged to the User in respect of any campaign covered by a Voucher. This agency fee waiver applies solely to campaigns funded by a Voucher and does not extend to any campaigns conducted outside the scope of, or beyond the value of, that Voucher.
The total Platform Spend of any campaign funded by a Voucher shall not exceed the available Voucher balance at the time of campaign submission. MALC shall not be obliged to proceed with, or to fund any portion of, a campaign whose estimated Platform Spend exceeds the available Voucher balance. The User may not supplement a Voucher-funded campaign with additional out-of-pocket payment in order to increase the campaign spend beyond the Voucher value.
A Beta Programme participant who wishes to conduct additional campaigns not covered by, or exceeding the value of, an issued Voucher may do so under MALC's standard commercial terms. In such cases, MALC's standard agency fee of 8% of the applicable Platform Spend shall apply, together with VAT at the prevailing rate of 15% on that agency fee, and payment shall be required in advance of campaign launch.
Each Voucher is valid for a period of fourteen (14) calendar days from the date of issuance (the "Validity Period"). Any Voucher balance remaining unused at the expiry of the Validity Period shall be automatically forfeited with no further notice required. Expired Voucher balances shall not be reinstated, extended, refunded, or carried over under any circumstances, except at MALC's sole and absolute discretion.
A User may apply the balance of a single Voucher across more than one campaign during the Validity Period, provided that the aggregate Platform Spend of all such campaigns does not exceed the total Voucher value.
Vouchers are strictly personal to the User to whom they are issued and are non-transferable. Vouchers may not be transferred, assigned, gifted, sold, shared, sublicensed, or otherwise made available to any third party, whether for consideration or not. Any purported transfer of a Voucher shall be null and void. MALC reserves the right to cancel, without liability, any Voucher that it reasonably believes has been transferred, shared, or otherwise misused.
Vouchers have no cash value and may not, under any circumstances, be redeemed for cash, credited to a bank account, applied as a credit against outstanding invoices, or exchanged for any monetary equivalent. Vouchers are redeemable solely against Platform Spend as described above.
Once a campaign funded by a Voucher has been launched and MALC has committed or disbursed the corresponding Platform Spend to the relevant third-party platforms, the full Voucher value applied to that campaign shall be deemed fully consumed and shall not be reinstated, refunded, carried over, or credited in any form, regardless of any subsequent cancellation, modification, suspension, or early termination of the campaign by the User. The User acknowledges and accepts that, upon campaign launch, MALC incurs immediate, irrecoverable, and non-refundable third-party platform costs on the User's behalf.
MALC reserves the right to modify, suspend, or terminate the Beta Programme, or to amend the terms applicable to Vouchers, at any time and at its sole discretion, without prior notice and without liability to any User. Any such modification shall not affect the terms applicable to Vouchers already validly issued and not yet expired at the time of modification, except where required by applicable law or regulation.
Save as expressly modified by this clause, all other provisions of these Terms shall continue to apply in full to Beta Programme participants and their use of the Service. Participation in the Beta Programme does not modify, limit, or waive any of the User's obligations, warranties, representations, or liabilities under these Terms.
